14th District Chancery Race is On! Starkville, Columbus, Houston, Okolona and more…

The State of Mississippi is divided into twenty Chancery Court districts. The Fourteenth Chancery Court District includes Chickasaw, Clay, Lowndes, Noxubee, Oktibbeha and Webster Counties.

There are three chancellors for the 14th district and all of them are retiring. Today’s post is about the Honorable Kenneth Burns‘ position. Judge Burns, first elected in 2003, has set a high standard for the future Judge to follow in his robe, er…footsteps.

So far, five candidates have qualified,  guaranteeing a runoff.

Elizabeth Fox Ausbern 

This candidate has been practicing law since 1993, the majority of which has been devoted to the area of chancery law. Her office is in Houston, MS.

“In my personal life, I have been faced with divorce and now the death of someone I love dearly. I know my personal experiences will equip me to empathize with those individuals before the court.“

The voting area will encompass Chickasaw and Webster counties and the precincts of South Adaton, South Longview, South Starkville, West Starkville, Sturgis/North Bradley, Self Creek:Double Springs, Center Gove/ North and Craig Springs/ South of Oktibbeha County.

Gene Barton

Barton, practicing for over 40 years, is from Okolona, MS. He has a general practice and approximately half of which is family law related.

Todd Bennett 

Practicing since 2007, Bennett handles domestic and real estate cases in Houston, MS and the surrounding area. These are matters heard in Chancery Court.

Rodney Faver 

“Faver is a partner in the law firm of Ward, Rogers & Faver, PLLC located in… Starkville, Mississippi. His firm provides a broad range of services to clients… with a special emphasis in Litigation, Criminal Defense, Personal Injury and Divorce cases.

Rodney P. Faver has over 27 years of trial experience in both Mississippi and Florida. Mr. Faver has dedicated his diverse legal career to the pursuit of justice for the people he represents, and is dedicated to the highest standards of excellence and integrity.“

Lee Ann Turner 

“Turner devotes most of her practice to family law and other chancery court matters at The Winfield Law Firm, P.A., in Starkville, MS. Since 2009 she has been appointed as a Special Master for commitments and Youth Court Referee for Oktibbeha County, served on dozens of cases as a Guardian Ad Litem to protect children’s interests in Chancery Court matters, is the Starkville School District’s Student Disciplinary Hearing Officer, and serves on the Board of Directors for Safe Haven, a domestic violence shelter located in Columbus.  Lee Ann is frequently asked to speak at continuing legal education seminars (CLE’s) and most recently gave a presentation on ethics at the Mississippi Judicial College’s Youth Court Judges’ Fall 2017 training seminar.   Lee Ann was also selected as one of Mississippi’s 50 Leading Business Women for the class of 2009 by the Mississippi Business Journal.“

J.D. in 1996 from the University of Alabama School of Law,  Editor-in-Chief of the Law and Psychology Review, a member of the Bench and Bar Legal Honor Society, Phi Delta Phi, and Managing Editor of the Law School newspaper.

“Before entering private practice in 2003, Lee Ann spent nearly 6 years as the Staff Attorney for the 14th District Chancery Court of the State of Mississippi, working for Chancellors Dorothy W. Colom, Kenneth M. Burns, Robert L. Lancaster, James S. Gore, and Woodrow W. Brand.“

Judicial Elections; Picking “Your” Divorce Judge

It is the season of qualifying for Judicial candidates.

From now through May, persons qualified to run, may throw their hat in the ring to become your next family law judge. The requirements are fairly basic for Chancellor;  be at least 26 years of age, a practicing attorney for five years, and a citizen of the state for five years. Miss. Const. of 1890, Art. 6, §§153 and 154; Miss. Code Ann. §9-5-1, and pay a fee of $100 to the Secretary of State’s Office.

Below is the current listing and the geographical area that the Judges are in. There will be many more persons qualifying in the coming weeks.

District 1: Alcorn, Itawamba, Monroe, Pontotoc, Prentiss, Lee, Tishomingo, Union

Stephen T. Bailey Chancery Court Judge 1, 4 *(The first number is the District, the second is the place.)

Bailey was recently appointed after the resignation of T.K. Moffett. Bailey was a solid choice for the appointment and will likely win even if opposed.

Jacqueline Mask Chancery Court Judge 1, 3

Current Chancellor.

Judge John Hatcher just announced his retirement which will mean another spot is available in this District.

District 4: Amite, Franklin, Pike, Walthall
Debbra K. Halford Chancery Court Judge 4, 1

Current Chancellor.

Wayne Smith Chancery Court Judge 4, 2

District 5: Hinds County
Dewayne Thomas Chancery Court Judge 5, 1

Current Chancellor. Judge Thomas will have this position for as long as he wants it.

Hinds County will be very interesting to watch as the three other current Chancellors, Owens, Singletary, and Wise, have all considered retirement.

District 6: Attala, Carroll, Choctaw, Kemper, Neshoba, Winston

This is a race to watch. Judge Williams, I believe, is retiring, and this a large area with lots of attorneys and will be interesting to see who qualifies.

I do not expect challengers to either sitting Judge, but it could happen.

This is another race to watch. Long serving Judge Mason is retiring and there are multiple quality candidates for this position.

The judicial race for Starkville, Columbus, Westpoint, etc. will be fun to watch. All three current chancellors, Colom, Burns and Davidson, are retiring. This means there will be three new family law judges for this district. I expect a lot of candidates and several of the more talked about names have not yet qualified.

Place 2 is a race to watch. Judicial stalwart John Grant is retiring and I expect 3-5 candidates for this position. It will also be a close race as those qualified, and expected to be, are all great candidates.

Judge Election Update: Rankin Chancery, Madison Chancery Judge Elections; Roberts in Rankin, Walker in Madison…

The votes are in. Rankin County is getting a new Family Law Judge, and so is Madison, Leake, Yazoo and Holmes Counties.

Haydn Roberts– current Family Master, former staff attorney has been elected to be the third Chancellor for Rankin County.  This position was recently created by the legislature due to population increases in Rankin County and is much needed and will be a welcomed relief to ease the docket crowding currently in Rankin County.

Roberts stated he was “[E}xcited…I’m going to give everything in me, of course. Looking forward to…Court.“

James Walker– current Family Master, former staff attorney and DHS attorney handily won the 20th Chancery District race. This too was created by the legislature due to population increases in the district.

Walker released a statement, “I am deeply humbled and appreciative to be the next Chancery Judge for Madison, Leake, Holmes, and Yazoo Counties. This could not have been done without the support of my friends and family. Thank you from the bottom of my heart. Last, but not least, thanks to the fine citizens of the 11th District for allowing me to serve you as your next Chancery Judge.”

Both candidates worked hard for their respective positions, campaigned with vigor and integrity and have the experience and demeanor to be great.

The Family Law Judiciary in Mississippi just got better!

Meet the Candidate; Madison County Justice Court Judge Election

Election season is in full swing. Here’s your chance to meet the candidate and get involved.

Kelly Williams, a candidate for Madison County Justice Court Judge, is having a meet and greet on Tuesday night at the Lake Caroline Martinique Clubhouse. It’s a causal, come-and-go event for residents, friends and voters from Madison County to meet Attorney Kelly Williams and to find out what a Justice Court Judge does.

The Martinique Clubhouse is in the North-West corner of Lake Caroline properties, just off Hwy 22 and the western most entrance to Caroline next to McMillon Road. 5:30-8:30 pm.

New Judges are Coming… 11th, 20th, & 4th Districts; The Scoop on the Candidates.

Family Law is not necessarily full of exciting news. Sure, we have juicy stories of debauchery, but that has occurred since man became upright…

But, getting 3 new Judge positions is exciting!

Governor Bryant signed into law a bill that creates 3 new judges to hear divorce, custody, child support, paternity, will, estate and land matters, among other limited areas of the law.

These 3 new judges will be over districts that have been in much demand for another Judge.

District 11 is getting a 3rd Judge. District 11 covers Madison, Leake, Holmes and Yazoo counties. The Current Judges are Cynthia Brewer and Robert Clark, III.

The candidate for this seat is James Walker (click for website). Walker is the current Family Master for the District, hearing Emergencies,Temporary Hearings and the types of matters the current Chancellors hear. Walker is the former staff attorney for Judge Cynthia Brewer and former staff attorney for DHS.  Walker is the definite front-runner (FB).

District 20 covers Rankin County and will likewise be getting a 3rd Judge.  The current Judge is John Grant.  There is a vacancy for the 2nd Chancellor due to the untimely passing of Judge Dan Fairly– which will be filled, most likely, by appointment and special election.

Craig Slay is the only candidate that has qualified for the new position, but the rumor mill has at least 4 other candidates in the mix. Slay is the Board Attorney for the  Rankin County Board of Supervisors and has practiced law for nearly 20 years. At the time of this post Slay’s social media presence was not readily apparent.

Prentiss Grant is one of those candidates. He has announced publicly to be in the running for Rankin Chancery Judge, though not listed yet on the Secretary of State’s website.  P. Grant has practiced for over 25 years and handled many Chancery Court cases, among criminal and personal injury areas of practice as well.

This will be an exciting race to watch!

District 4 covers Amite, Franklin, Pike and Walthall counties and will be getting a much needed second Chancellor.

Conrad Mord is the only candidate to toss his hat in the ring so far. Mord has practiced in the district for 40 years and currently serves as the Youth Court Referee, a.k.a. Youth Court Judge. The current lone Chancellor is Debbra Halford.

Stay tuned for all of your Family Law Judge news.  This election coverage will be updated as more candidates qualify, though not so much coverage as to be soul-crushing to the casual reader!

Here Comes the Judge; Election Results

Mississippians elected some new Judges and re-hired some familiar ones.  Of the contested elections here’s what we have so far.

Winners in Bold.

Chancery Court, District 11, Place 1 (Madison, Yazoo and Holmes)

This is a new Judge as Judge Goree is retiring.

Chancery Court, District 8, Place 2 (The Coast)

Chancery Court, District 8, Place 3 (The Coast)

Chancery Court, District 13, Place 1 (Covington, Jefferson Davis, Lawrence, Simpson & Smith)

This race was interesting as the incumbent, Shoemake, ran and won against Buffington in the last election – who was the Judge prior to Shoemake. Buffington sought to be re-hired, Shoemake held the seat.

Chancery Court, District 13, Place 2 (Covington, Jefferson Davis, Lawrence, Simpson & Smith)

Heading for a run-off between Martin and Burnham. This seat was vacated by Joe Dale Walker for Judicial misconduct.

Chancery Court, District 16, Place 1 (The Coast)

Too close to call and are still counting affidavit ballots.

Fondren will be a new Chancery Judge and this race was interesting as the outgoing Judge, Chuck Bordis, withdrew from the race. There was gossip of soap opera issues between Bordis and Fondren.  Interestingly, its exactly the type of matters Chancery Judge’s hear. Nothing better than real-life experience for preparation for the job.

Judge Candidate Pledges to Donate to Charities, Matching Monies Spent by Opponent

Here’s a fresh take on Judicial campaigning.

Joseph A. Scalia Candidate for Family Court Judge – Department B

A candidate for Nevada Family Court Judge, attorney Joseph Scalia, has announced a dramatically different approach to running his campaign for Judge.  Instead of the usual fund-raising and spending, Scalia has pledged to match, dollar for dollar, all monies spent by  his opponent on campaigning with matching donations to local, non-profit charities in the Las Vegas, Nevada area.

Citing  an example of unnecessary spending, Scalia noted that his opponent spent $100,000.00 in the primary and garnered 19,000 votes.  Scalia spent a reported $0.00, that’s zero!, and garnered over 16,000 votes.  No candidate received a majority so there will be a run-off.

So, political advisers, campaign strategist and consultants take heed,  Joe Scalia is throwing judicial and political campaigning on its ear.

Chancery Judge Campaign in Full Swing.

Madison, Yazoo, Leake and Holmes Counties will be getting a new Chancery Judge in the November 4, 2014, election.

A Chancery Judge hears matters involving wills and estates, child support and custody of minor children, divorces and alimony, and lunacy or commitment hearings.  The Judges also handle other matters, such as petitions to incorporate or enlarge a city, the establishment and management of drainage districts, children’s welfare funds, and other projects.

Why should you care?  Because this will be your judge if you find yourself in Court and it’s not due to a criminal case, a car wreck or an unpaid bill.

Who are the Candidates?

Bluntson has practiced law in Mississippi for the past 20 years.  She began her legal career in 1994 as a staff attorney for Mississippi Child Support.  Thereafter, she opened her private law firm where she handled divorces, child support, child custody and wills & estates cases.  A few years after the death of her husband, Barbara Ann was hired by the City of Jackson as the Chief City Prosecutor.  She maintained that position for 10 years.  As city prosecutor, Barbara Ann and her staff prosecuted in excess of 8,000 misdemeanor cases per year.  She also assisted domestic violence victims with Petitions for Protective Orders when they were filed in municipal court.  Barbara Ann currently serves as Deputy City Attorney for the City of Jackson and City Prosecutor for the City of Durant.  She is also a certified Family Law Mediator.

Clark is running for Chancery Judge because he believes the citizens of the 11th Chancery District would benefit from his experience, skills and proven record of serving the public in the district; as an Attorney, Municipal Judge and Youth Court Judge.  He has represented the citizens of the district in Chancery Court handling all types of cases. He touts that he is the only candidate that was born, raised and practiced law in District 11, Sub-district 1.  If elected Judge he promises to work daily to be fair and impartial judge who demonstrates sound judgement and run an efficient court.
